"on or about June 25, 2003 within the Southern District of California, the defendant Wolfgang M. Grabher did knowingly and willfully make a false claim in an application for a United States Visa with intent to induce or secure the issuance of a U.S. Visa as evidence of authoirized stay or employment in the U.S." "Knowing it to have been procured by means of any false claim or statement, to wit: GRABHER completed a U.S. Nonimmigrant Visa Application (form DS-156) in which he failed to disclose his previous criminal arrest record, all in violation of title 18, U.S. code Section 1546a."
According to Special Agent R. Christopher Good Grabher had perjured himself in filing U.S. Visa entry documents citing Grabher under oath in the matter of Triagon Holding AG vs. defendant Wolfgang M. Grabher on 9/12/06 in San Clemente, CA "questioning Grabher if he was convicted and found guilty of offenses in Stuttgart Germany whereby Grabher answered, "YES". Further questioning Grabher "whether he had a prior conviction which he was sentenced to prison for business fraud and put on probation?" To which Grabher answered "YES." Again Grabher being convicted of fraud using his very own words. Special Agent R. Christopher Good US Department of State futher lists Wolfgang Grabher's violation of moral turpitude.
1) "January 19, 2003 Grabher was arrested for the charge of Inflicting Corporal Injury on a Spouse/Cohabitant Iva Knopf in violation of California Penal Code Section #273.5, reference arrest report #SD AR 03101726A.
2) June 25, 2003 Grabher filing fraudulant U.S. Visa documents violating U.S. Title 18 U.S.C. 1546(a)
3) "August 27, 2003 Wolfgang M. Grabher was arrested and convicted in Stuttgart Germany for the crime of "NEGLIGANT DRUNKENNESS in Traffic in primary conjunction with resisting Police Officers" date of last offense 05/27/03 in violation of the Applicable statutes Criminal Code 316(1),(2),69,69A,113,63. Grabher was sentenced and had his Drivers license suspended."
4) March 17, 2006 Grabher was arrested for the charge of Battery of a Person in violation of California Penal Code Section #243A, reference police report #SD AR 06111819.
These severe grievances with clear violation of moral turpitude were attempted by Wolfgang M. Grabher to be withheld from U.S. authorities in a fraudulant effort to obtain a U.S. passport. These posted violations DO NOT include Wolfgang M. Grabher's multiple forgeries and 5 reported Sarbanes Oxley violations of the U.S. Securities and Exchange Commission.
